Georgian Courts: Choosing the Application That Can Help

Distinguish a claim, an appeal, interim protection and enforcement so the legal work addresses the actual obstacle.

Identify the decision you need

If nobody has decided the dispute, a claim may be needed. If a decision is wrong, consider the available challenge. If a favourable order is not being carried out, identify the enforcement issue. Sending the same complaint to several institutions may leave the operative problem untouched.

Give counsel the court, case number, latest operative decision and how it was delivered. Those details help identify the relevant procedure and the deadline that needs attention.

Make an appeal address the error

An appeal needs a reason to change the decision and a clear request for what should replace it. Identify an important fact that was overlooked, a mistaken legal conclusion or a procedural failure. Connect each point to its consequence for the outcome.

Example: an agency opinion was accepted without addressing a disputed factual basis. The challenge should identify the missing assessment, where the issue was raised and why it could change the decision. Repeating that the result is unfair does not supply that explanation.

Consider what cannot wait

A child’s contact, a threatened transfer of disputed property or another urgent change may need a separate interim application while the main case continues. Describe the specific measure sought and why a later judgment would not adequately address the present harm.

Interim measures, appeals and challenges to particular rulings have different requirements. Have counsel identify the applicable remedy and time limit for the actual decision rather than relying on a single deadline remembered from another case.

Make the requested result workable

A proposed order should identify the person who must act, the act required and any necessary dates or arrangements. In a contact dispute, a vague promise to allow meetings leaves handover and timing unresolved. In a payment claim, the amount and its basis need to be clear.

Before a hearing, agree the issues counsel will ask the judge to decide and any outstanding application requiring attention. After the decision, obtain an explanation of the next deadline and the step needed for implementation.

Discuss the decision blocking the next step

Send the operative decision and its delivery date. Agree whether the immediate work is a challenge, an interim application or implementation of an existing order.
