Get the actual request
Ask for the investigator’s name, the office, the case reference, the time and the capacity in which you are being called. Send the message or summons to your lawyer. A telephone invitation does not explain every procedural consequence.
Article 113 regulates a voluntary interview, while other procedures may involve a summons or questioning before a magistrate. Have the lawyer identify which procedure is being used; do not assume every request is voluntary or simply disregard a formal summons.
Arrange advice before the account is given
Explain the subject to the lawyer privately, including facts that concern you. An interviewee under Article 113 may use a lawyer and has protection against self-incrimination. If a language problem may affect your answers, raise the need for an interpreter before the procedure starts.
The aim is to understand your status, the question being investigated and the rights that apply before you give a detailed account. Do not invent an explanation to fill a gap in memory.
If you are detained or treated as an accused person
Tell the lawyer your location and when your liberty was restricted. Article 38 addresses rights including legal assistance, silence and language protection for an accused person. Raise any health issue or injury and the need for appropriate medical attention immediately.
Before signing, have the text interpreted where necessary and identify statements or omissions that do not reflect what occurred. The lawyer should address objections through the applicable procedure.
Example: a director is asked about company payments
A question about a company transfer may concern authority to pay, the purpose of the payment and who gave instructions. The useful preparation is to identify the real transaction and the people involved so counsel can advise on the legal significance.
Preserve the original business material and discuss it with counsel. Do not delete messages, manufacture supporting documents or coordinate an invented account with other witnesses. Agree who will attend, the immediate legal work and how counsel will respond if your procedural status changes.
